Terms and Conditions

1. The promoters of this competition are (i) The Balmoral Hotel Edinburgh Ltd. Registered in England, company registration number is 08472373 Trading as The Balmoral Hotel Edinburgh Ltd. Registered VAT number is 160 3148 42. (ii) Hamilton & Inches Ltd, a company registered in Scotland, whose company registration number is SC041917 and registered office is at 16 Charlotte Square, Edinburgh, EH2 4DF. Hamilton & Inches’ main trading address is 87 George Street, Edinburgh, EH2 3EY. Hamilton & Inches’ registered VAT number is 717 0677 30.

2. The title of the competition is ’12 Days of Christmas Competition’. The competition is a prize draw allowing entrants to submit their wish for the festive season.

3. Entrants to the competition must be aged 21 or over.

4. Entries to the competition will not be accepted from employees of the promoters, their families, agents or any third party directly associated with the administration of the prize draw.

5. The competition may only be entered online via the Rocco Forte Hotels entry form or using the entry form on the wishing tags at The Balmoral or Hamilton & Inches. Entrants will be required to fill out details of their full names, email addresses, postal addresses and telephone numbers.

6. The competition will be open for entry between 22nd November 2019 and 23.59 on 23rd December 2019.

7. To enter the competition, you must complete the forms referred to in clause 5.

8. The promoters accept no responsibility for entries not being successfully completed due to any technical fault, technical malfunction, computer hardware or software failure or satellite, network or server failure of any kind.

9. By registering for the competition, you are agreeing to be bound by these terms and conditions and confirm that you are aged 21 or over. The promoters may require entrants to provide proof of age.

10. Winners

A. The winners will be selected by random draw performed by a computer process initiated by the promoters between 1 and 24 December 2019. The winners will then be notified of their win by email to the address provided on registration.
B. If the winners do not respond to the promoters within 14 calendar days of such notification, or otherwise do not accept their prize, they will forfeit their right to the prize and the promoters may select another winner to replace them in accordance with the process described above provided that the promoters may organise the new draw and make the ensuing notification on such dates as it reasonably decides.
C. Final responsibility for determining the operation of each draw, including eligibility and the identity of the winners, rests with the promoters. The promoters’ decision regarding any aspect of the draw is final and binding on all entrants and no correspondence will be entered into about it.
D. The winners agree to take part in all reasonable competition related publicity surrounding the winning of the prize and consent to the promoters using their name in promotional materials.
E. The winners must collect their prizes in person from The Balmoral or Hamilton and Inches.

11. Prizes

A. The prizes for the competition are as described below, subject to the terms set out below. The winners who have responded to notification of their win by the promoters under clause 11 and accepted their prize will be provided with details as to how to do this.

B. Each prize is to be redeemed within six months of announcing the winner and the promoters reserve the right to substitute any element of the prize.
C. The prizes are non-transferable and non-exchangeable, and no cash alternative is offered.
D. In regards to all experiences at The Balmoral, advanced booking is required, all experiences are subject to availability and blackout dates may apply.
E. Except as expressly stated, the prize does not include any travel arrangements or expenses, and if you win you will be responsible for ensuring that you and any person travelling with you are available to travel and hold valid passports, any necessary visas and any other documents you require, as well as for the costs of travel. Dates for accommodation once requested and accepted by The Balmoral cannot be changed.
F. Any additional costs incurred during stays at The Balmoral will be invoiced to the guest at the end of their stay.

12. Entrants that do not comply in full with these terms and conditions may be disqualified at the discretion of the promoters. The promoters reserve the right to refuse entry or refuse to award prizes to anyone in breach of these terms and conditions.

13. The promoters reserve the right to amend, alter, or withdraw this competition without prior notice where it becomes necessary to do so.

14. The promoters reserve the right to replace any prize with an alternative prize of equal or higher value if circumstances beyond the promoters’ control makes it necessary to do so.

15. Insofar as permitted by law, the promoters, their agents or distributors will not in any circumstances be responsible or liable to compensate the winners or accept any liability for loss, damage, personal injury or death occurring as a result of taking up the prizes where it is caused by the negligence of the promoters, their agents or distributors or that of their employees. Your statutory rights are not affected. The promoters shall not be liable for any failure to comply with their obligations caused by (but not limited to) weather conditions, fire, flood, strike, hurricane, industrial dispute, war, terrorist activity, hostilities, political unrest, riots, civil commotion, loss of connectivity, Internet or email failure or any other circumstances beyond the control of the promoters.

16. By entering the competition, you agree that your personal information may be held and used by the promoters or their agents and suppliers for the purposes of the competition. Your information will not be used for any purpose other than as stated in these terms unless separately accepted by you.

17. If there is any reason to believe that there has been a breach of these terms and conditions, the promoters may, at their sole discretion, reserve the right to exclude you from participating in the competition.
